What is a deed transfer?



If a title is the legal concept of ownership, then what is a deed? A deed is the document that verifies this ownership. The deed is the vehicle through which a title is transferred from one party to the next. There are different types of deeds that may be used. A title and a deed are distinct in that one is a concept and the other is a document. A title indicates that you own the home, while a deed is proof that said ownership was transferred.



General Warranty Deed



A general warranty deed indicates that the grantor (seller), has a right to sell the property and a clear title. This kind of deed provides the grantee (home buyer) with the strongest protection because it protects the grantor and will defend the buyer against any claims made by third parties about the property.



Special Warranty Deed



A special warranty deed is different from the general warranty deed, in that it only guarantees that the current grantor’s portion of the title is clear. It doesn’t warranty that previous owners were free of title discrepancies, thereby providing less protection to the grantee (home buyer) than a General Warranty Deed.



Quitclaim Deed



A quitclaim deed effectively transfers title to the grantee (home buyer), without any warranties. This type of deed is commonly used when transferring property between family members. quitclaim deeds require immense trust between the parties as they offer little legal protection.
